WINDOWS 95 ========== 1) Insert the compact disk into your CD-ROM drive. 2) Click on the Install button below the Mortalus auto-run graphic. or If you have disabled the auto-run feature, choose the Run command from the Start menu on your desktop. In the Run dialog box, type D:\SETUP.EXE, where D is the letter name of your CD-ROM drive. Then click on the OK button. If you are not sure which drive letter your CD-ROM drive uses, open the Explorer and look for the CD-ROM drive icon. The name of the drive will appear with the CD-ROM drive icon. 3) Follow the on-screen instructions. (B) Running Mortalus ==================== WINDOWS 95 ========== Please note: You need to quit all other applications before running Mortalus. If you have other applications open while running Mortalus you may experience technical difficulties. 1) Insert the compact disk into your CD-ROM drive. 2) Click on the Play button below the Mortalus auto-run graphic. or If you have disabled the auto-run feature, choose the Programs option from the Start menu on your desktop. From the H+a's Program Group, click on the Mortalus icon. Minimum System Requirements =========================== Your computer must meet or exceed the following system requirements: Pentium 100 Windows 95 24 MB RAM (minimum) Four-speed CD-ROM drive SVGA card and monitor (640x480), thousands of colors Sound Blaster or 100% compatible sound card (C) Improving the Performance on Microsoft Windows 95 ===================================================== The performance of any CD-ROM application is greatly affected by the speed of your computer, the speed of your CD-ROM drive and the amount of RAM your system has available. Defragmentation =============== A drive that has had a lot of file activity will run slowly. If your hard disk is fragmented, please run the Disk Defragmentation program found under: Start menu -> Programs -> Accessories -> System Tools -> Disk Defragmenter. (D) Troubleshooting =================== 1. Sound ======== If you're experiencing any sound problems with Mortalus, contact the manufacturer of your sound card to make sure you have the latest drivers. If you still have difficulties after installing the latest drivers, and your sound card is working with other Windows applications, contact H+a's Technical Support. 2. Video ======== If you're experiencing any problems with graphics or animations in Mortalus, contact the manufacturer of your video card to make sure you have the latest drivers. H+a reserves all rights not expressly granted under this Agreement. 2. COPY AND USE RESTRICTIONS You may: a) use the Software for your own personal use and you may use one copy of the Product on a single terminal connected to a single computer; b) make one copy of the Software for backup or archival purposes only; c) transfer the Software from one computer to another provided that the Software is used on only one at a time; d) transfer the Product provided that you assign the Software (including upgrades and prior versions), all Documents and all your rights under this Agreement on a permanent basis, you cease all use of the Software and delete the setup file from your computer, and the recipient agrees to the terms of this Agreement; e) if the Product is an upgrade from a previous version, you may use or transfer the Product only in conjunction with the upgraded product, unless it is destroyed. COPYRIGHT The Software, including any images, photographs, animation, video, audio, music and text incorporated in the Software, and the Documents are protected by copyright and international treaty provisions. You may be held legally responsible for any copying or copyright infringement caused or encouraged by your failure to abide by these restrictions. 4. TERMINATION This license is effective until terminated. It will terminate automatically without notice from H+a if you fail to comply with any provision of this Agreement. Upon termination you shall destroy all copies of the Software and all Documents. All provisions relating to warranties, limitation of liability, remedies or damages, and H+a’s ownership rights shall survive termination. 5. 90 DAY WARRANTY H+a warrants that the storage media on which the Software is delivered will be free of substantial errors or defects in materials and workmanship under normal use for 90 days from the original retail purchase. This policy applies to the initial purchaser only. No other advertising, description or representation, whether made by a H+a dealer, distributor, agent or employee, shall be binding upon H+a or shall change the terms of this warranty (“Limited Warranty”). H+a’s entire liability and your exclusive remedy will be, at H+a’s option, either (a) return of the price paid or (b) repair or replacement of the storage media that does not meet the Limited Warranty and that is returned with a copy of your receipt. This Limited Warranty is void if failure has resulted from accident, abuse, or misapplication. This Limited Warranty gives you specific legal rights and you may have other legislated rights which vary by jurisdiction. 6. LIMITATION OF WARRANTIES AND LIABILITY EXCEPT FOR THE EXPRESS WARRANTY ABOVE, THE PRODUCT IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, H+a DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. You assume the entire risk as to the results and performance of the Product. Subject to applicable law, under no circumstances will H+a (or its suppliers, dealers, agents, directors, officers, employees or contractors) be liable for any indirect, incidental, special or consequential damages whatsoever that result from the use of, or the inability to use, the Product (including lost profits or revenues, lost or damaged data or other economic loss) even if H+a has been advised or is aware of the possibility of such damages or for claims by a third party. In no event shall H+a’s (or its suppliers’ or dealers’) total liability to you for all damages, losses, and causes of action exceed the amount paid by you for this Product. The limitations in this section shall apply whether or not the alleged breach is a breach of a fundamental condition or term. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, the above limitations may not apply to you. 7. EXPORT LAW ASSURANCES You may not use or otherwise export or re-export the Software except as authorized by United States law and the laws of the jurisdiction in which the Software was obtained. In particular, but without limitation, none of the Software may be used or otherwise exported or re-exported (i) into (or to a national or resident of) a United States embargoed country or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce's Table of Denial Orders. By using the Software, you represent and warrant that you are not located in, under control of, or a national or resident of any such country or on any such list. 8. U.S. GOVERNMENT RESTRICTED RIGHTS This Product is provided with restricted rights. Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software Restricted Rights at 48 CFR 52.227-19 or clause 18 52.227-86(d) of the NASA Supplement to the FAR, as applicable. OTHER This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and of the laws of Canada applicable therein. This is the entire agreement between the parties relating to the subject matter herein and may not be modified except in writing, signed by both parties. The parties have requested that this Agreement and all documents contemplated hereby be drawn up in English.
