I. MINIMUM SYSTEM REQUIREMENTS
------------------------------------
When playing "The Incredibles: When Danger Calls" on a minimum specification computer, be sure that no other programs are open on your Macintosh or in Windows, as this will cause the game to play more slowly than normal.
The following are the minimum system requirements for "The Incredibles: When Danger Calls" on a Windows-based PC:
- Intel Pentium II processor running at 266 MHz
- Microsoft Windows 98/2000/ME/XP
- 64 MB ram
- 160 MB Hard drive space free
- 8X CD-ROM drive
- Video card with at least 8 MB RAM
- DirectX 9.0 (included on game CD)
- DirectX-compatible display capable of 800x600 resolution in 16-bit color
- Microsoft-compatible mouse
This game uses Microsoft's DirectX 9.0 technology, which requires your system to have the latest Windows drivers that fully support DirectX 9.0. If DirectX 9.0 is not already installed on your computer, the game will run in a lower graphics setting.

The following are the minimum system requirements for "The Incredibles: When Danger Calls" on a Macintosh computer:
- Mac OS X version 10.2 or later
- G3 or G4 266MHz iMac, iBook, PowerBook, Power Macintosh
- 128 MB RAM
- 160 MB free hard drive space
- 8X CD-ROM drive
- 8MB VRAM
- Thousands of colors video display
- QuickTime
Note: The game will not run properly in Mac classic mode.

II. INSTALLING THE GAME
-----------------------------
Before installing the game, close all other applications.
For Windows:
1. Insert the "The Incredibles: When Danger Calls" disc into your CD-ROM drive and wait a few moments until the "The Incredibles: When Danger Calls" autorun splash screen appears. If the splash screen does not appear, please refer to the AutoPlay section of this readme file.
2. Click the Install button to begin the installation process and follow the on-screen instructions.
For Macintosh:
1. Insert the "The Incredibles: When Danger Calls" disc into your CD-ROM drive and wait a few moments until the CD is mounted.
2. Click on the CD to open.
3. Click on "The Incredibles" Installer and follow the on-screen instructions.

III. UNINSTALLING THE GAME

For Windows:
To uninstall the game, select Start->Programs->THQ->"The Incredibles - When Danger Calls"->Uninstall"The Incredibles - When Danger Calls"
NOTE: You should always uninstall the game using the Uninstaller provided.
For Macintosh:
To uninstall the game, drag the "The Incredibles - When Danger Calls" folder to the trash, then empty the trash can.

IV. STARTING THE GAME

For Windows:
After installing "The Incredibles: When Danger Calls" you can run the game by double-clicking the "The Incredibles - When Danger Calls" shortcut on your desktop, by choosing Start->Programs->THQ->"The Incredibles - When Danger Calls" or by clicking the Play button on the "The Incredibles: When Danger Calls" splash screen that appears after the game AutoPlays. To play "The Incredibles", the "The Incredibles" CD must be in your CD-ROM drive at all times.
For Macintosh:
After installing "The Incredibles: When Danger Calls" you can run the game by clicking on the "The Incredibles" icon in the "The Incredibles - When Danger Calls" folder. To play "The Incredibles: When Danger Calls", the "The Incredibles: When Danger Calls" CD must be in your CD-ROM drive at all times.

V. GAME CONTROLS
----------------------
GENERAL NOTES
Each game has three difficulty levels with seven sub-levels each. This means there are a total of twenty-one rounds for each activity in the game.
HELP MOVIES
* To play an interface help movie, click on the "?" button in the Main Menu.
* To play the game instructions movie while inside a game, click on the ESC key, then click on the "?" button that appears in the pop-up menu.
SIGN-IN SCREEN
* The six pictures of the characters show you where you can save your game. Click on one to save your game.
* Remember which picture you chose so you can load your saved games again. To open just click on the same picture!
* If you want to clear out your old scores from a saved game, just click the recycle button above that picture.
* Choose your difficulty level by clicking on the small, medium or large barbell.
* You can also look at all of your scores by clicking on any of the scoreboards above the pictures.
* When you're done, click on the right arrow to go to the Main Menu.
* Click on the question mark button to see the Help movie.
MAIN MENU
* Choose a "Normal" activity by clicking on one of the characters in their everyday clothes (Bob is wearing a workout suit).
* Click "The Incredibles" logo buttons under each character to switch between their NORMAL and their SUPER (Incredible) games.
* Choose an "Incredible" activity by clicking on one of the characters in their super suits.
* Extra games and content on the right side of the screen can be unlocked by completing the activities.
* Click on the Options button to change game settings.
* Click on the Extras button for coloring pages and other goodies.
* Click on the left arrow button to go back to the Sign-in screen.
* Click on the "X" button to quit the game.
* Click on the question mark button to see the Help movie.
EXTRAS MENU
* Click on a button on the left side of the screen to select one of the extras. Then click on one of the pictures in the window. The confirmation button at the bottom of the screen will light up. Click the confirmation button to activate the extra.
* Click on the question mark button to see the Help movie.
EXTRAS MENU (PC Notes)
* Printables are sent directly to your printer. Please make sure you have a printer connected to your PC and the proper printer driver installed before attempting to print.
* Wallpapers are installed directly onto the desktop on Windows XP and Windows 98 systems. For Windows 2000 systems, the wallpapers are placed in the Incredibles Wallpaper folder on the user's desktop and need to be installed manually. To install the wallpapers on a Windows 2000 system, right-click on the desktop and choose Properties to bring up the Display Properties dialog. Select the Desktop tab, then click the Browse button. Navigate to the desktop and then to the Incredibles Screensaver folder. Double-click on the wallpaper you wish to install.
* The Screensaver installer is placed on the user's desktop. To install the screensaver, double-click the Incredibles Screensaver.exe on the desktop; no dialog boxes will appear, but the screensaver will be installed. To activate the screensaver, right click on the desktop, select the Screen Saver tab and then select Incredibles Screensaver, then click the OK button. The Incredibles Screensaver.exe file can be deleted or moved from the desktop once the screensaver is installed.
* The Theme Icons are copied into the folder Incredibles Icons on the user's desktop. To use the icons, you must first install them from within the game. Right-click on the file or shortcut you want to customize, then choose Properties. Click the Change Icon button and then the Browse button. Navigate to the Desktop, then the Incredibles Icons folder, and double-click on the icon you want to use.
* Movies that have been unlocked by completing certain portions of the game can be played from within the game.
EXTRAS MENU (Mac Notes)
* Printables are sent directly to your printer. Please make sure you have a printer connected to your PC and the proper printer driver installed before attempting to print.
* Wallpapers are copied to the Library/Desktop Pictures folder. To install them, click System Preferences->Desktop & Screensaver to open the Desktop and Screensaver dialog box. Click the Desktop button, then select Apple Backgrounds. Scroll though the thumbnail images to see all of "The Incredibles" wallpapers you've installed so far.
* The Screensaver installer is placed in the MacExtras folder and run automatically from within the game. When you quit the game, click the OK button to finish the installation. To adjust the screensaver settings, click System Preferences->Desktop & Screensaver to open the Desktop and Screensaver dialog box. Click the Screensaver button, then select Incredibles Screensaver.
* The Theme Icons are installed to the Incredibles Icons folder on the user's desktop. To use the icons, you must first install them from within the game, then click on the icon you want in the Incredibles Icons folder and hit Command-I to open the GetInfo dialog. Click on the icon under the General tab and hit Command-C to copy it into the clipboard. Now click on the file or folder you want to customize and hit Command-I to open the GetInfo dialog. Click on the icon and hit Command-V to paste the custom icon over the original one, then close the dialog box. The icon should change to the custom one in a moment.
* Movies that have been unlocked by completing certain portions of the game can be played from within the game.
OPTIONS MENU
* Click on the buttons next to the megaphone to set the volume higher or lower for the sound effects.
* Click on the buttons next to the musical note to set the volume higher or lower for music.
* Click on the "CC" button to turn the Closed Captions on or off.
* Click the crowd button to see the game credits.
* Click the left arrow button to go back to the Main Menu.
* Click on the question mark button to see the Help movie.
SCOREBOARD
* The scoreboard shows the scores of all the players.
* Click the left arrow button to go back to the Main Menu.
* Click on the question mark button to see the Help movie.
TRAINING MR. INCREDIBLE
* From the Main Menu, click on Bob Parr (in his gray workout outfit) to activate the game.
* Bob needs to get in shape. Help him lift the train cars.
* Keep an eye on the green bar moving up and down in the Power Meter. Whenever it passes next to "The Incredibles" logo, the logo will light up.
* When "The Incredibles" logo lights up, quickly hit the space bar to make Bob lift the train cars.
* You must attempt a lift before all the dots around "The Incredibles" logo turn black!
* Be careful not to hit the space bar too soon, or too late! If you hit the space bar when the indicator is outside the brackets, you'll lose the game. Now repeat these steps for all three stages of the freight train lift.
KITCHEN CHAOS
* From the Main Menu, click on Helen Parr (in her everyday clothes) to activate the game.
* It's Jack-Jack's bath time-but Dash is making a mess in the kitchen!
* Help Helen catch the items that Dash knocks over by using your mouse to stretch her hand around the kitchen.
* Catch all the falling items before they hit the floor and break. The breakables icons show how many items you can lose before the game is over.
* Don't let the baby cry. Tap the space bar once to calm him down when he starts to fuss.
* Keep going until time runs out, and Bob gets home to stop Dash.
VIOLET'S DIARY DRAMA
* From the Main Menu, click on Violet Parr (in her everyday clothes) to activate the game.
* Try to stop Dash from taking Violet's things.
* If you see Dash sneaking up on any of Violet's stuff, move your mouse and click where you want the forcefield to appear. Use the forcefield to keep Dash away from Violet's stuff.
* You can try to trap Dash with a force field if he tries to get away with something.
* The different icons on the left side of the screen represent Violet's private stuff; if all of them get crossed out, you will have to try again.
* Hold Dash off until the timer runs out and Helen comes to the rescue.
DASH VS. DETENTION
* From the Main Menu, click on Dash Parr (in his everyday clothes) to activate the game.
* Help Dash play pranks on his teacher by putting objects on his chair without getting caught.
* Use your mouse to move Dash quickly from his desk to the teacher's chair to place the prank items. Use your mouse again to get Dash back to his seat before the teacher sees him.
* Be careful not to bump into anyone or anything-or you'll get caught. If you get caught too many times the game is over.
* Next to the Dash icon are prank items you can put on the Teacher's chair. You can begin when he startstowriteonthechalkboard.
* Next to the chair icon are dots that represent how many prank items you'll need to place on the Teacher's chair before he finishes writing on the chalkboard.
* Keep your eye on how many prank items you have and how many you have used or lost.
* When all the prank items are gone, the teacher will take his seat, and YIKES!
* But remember, the teacher is VERY suspicious of Dash, and may stop once and while to check on you. Be sure Dash is sitting in his seat when the Teacher turns around.
FROZONE'S FIREFIGHTER
* This game is unlocked by winning all of the Normal games (listed above) at least once.
* From the Main Menu, click on Frozone (in his blue super suit) to activate the game.
* The fire will be out of control before the fire trucks even arrive, so help Frozone put it out.
* Use the mouse to target a window, and click the mouse button to put out the fire.
* If you can put out all of the fires, the building will be saved.
* Keep Frozone's freeze meter filled by clicking on the drinking fountain.
* If all the windows fill up with flames, the building will be lost.
VELOCIPOD BOWLING
* This game is unlocked by winning the Training Mr. Incredible game (Bob in his workout outfit) at least once.
* From the Main Menu, click on Mr. Incredible (in his red super suit) to activate the game.
* Help Mr. Incredible make his way into Syndrome's island base, which is guarded by Velocipods.
* Mr Incredible will rip a Monopod off its track. Move the mouse to aim the Monopod at the Velocipods by watching which arrows light up, then click the mouse button to lock in the direction. Aim carefully since there are a limited number of Monopods.
* The power meter will move automatically. Click the mouse when you think it's at the right level of power to throw the Monopod across the big gap.
* With each Velocipod you knock out of the way, some of the laser beams blocking the gate will shut off. Shut down all of the beams to win.
ELASTIBOAT ESCAPE
* This game is unlocked by winning the Kitchen Chaos game (Helen in her everyday clothes) at least once.
* From the Main Menu, click on Mrs. Incredible (in her red super suit) to activate the game.
* Help Mrs. Incredible, Dash and Violet reach land.
* Use the arrows on your keyboard to navigate your way past the water obstacles to help them get to Nomanisan Island.
* Hitting a water obstacle will slow you down and cost you a try. When all the tries are used, the game is over.
* Collect power-ups to give Dash a speed boost.
* The countdown timer will show you how much time to have left before Syndrome's forces find you and the game is over.
VIOLET SURROUNDED!
* This game is unlocked by winning the Violet's Diary Drama game (Violet in her everyday clothes) at least once.
* From the Main Menu, click on Violet (in her red super suit) to activate the game.
* Help Violet disable all of the guards without being spotted.
* The cannons fire sticky balls. Watch out, Violet can be hit by these even if she's invisible. (Note: clicking the mouse button toggles between Violet's invisible state and her force field state)
* Click the mouse button to create a force field around Violet that can bounce the sticky balls back towards the guards.
* Violet can't be invisible and use a force field at the same time.
* When all of the Violet icons are crossed out, the game is over.
100 MILE DASH
* This game is unlocked by winning the Dash vs. Detention game (Dash in his everyday clothes) at least once.
* From the Main Menu, click on Dash (in his red super suit) to activate the game.
* Help Dash make it through the jungle before time runs out.
* To make Dash move faster, move the mouse to the right side of the screen.
* To make Dash move slower, move the mouse to the left side of the screen.
* Watch out for pits, rocks and other obstacles or Dash will trip, losing a try. When all his tries are used up, the game is over.
* Avoid sticky balls fired from the Velocipods.
* To avoid obstacles, press the mouse button to make Dash jump.
* Dash can jump onto Velocipods. Once he's on a Velocipod, hit the space bar repeatedly to help Dash knock out the pilot.
* The higher the Velocipods fly, the more points they're worth.
* Knock as many of the Velocipods out of the air as you can before time runs out.
OMNIDROID FINAL BATTLE
* This game is unlocked by winning all of the other games at least once.
* From the Main Menu, click on the Omnidroid to activate the game.
* Help protect "The Incredibles" from the Omnidroid's attacks until time is up.
* Watch as different attack icons appear, and then hit the different arrow keys when the attack icon is inside the window.
* So As long as you keep hitting the right keys, "The Incredibles" will hold off the Omnidroid's attacks.
* Frozone can help if you make a mistake, but only as long as he has enough ice showing in the freeze meter.
* If you hit the wrong key once Frozone is out of ice, you'll lose the game.

VI. TROUBLESHOOTING
-------------------------
THQ thoroughly tests its games on a variety of systems before they are released, but it is virtually impossible to test on all combinations of software and hardware. Many of the issues you may encounter are caused by device drivers for video cards, sound cards and CD-ROM drives that are not fully compatible with the Windows operating system and/or DirectX. The following troubleshooting tips are intended to assist you in solving some of the common issues you might experience in relation to the game.
---(a) DirectX 9.0 for Windows---
During the "The Incredibles" installation process, the program will determine if Microsoft DirectX 9.0 needs to be installed on your computer. If so, the install program will notify you that you need to upgrade. Please select "Install DirectX" from the autorun screen. The Microsoft DirectX 9.0 setup program will install the appropriate files on your computer. After installation of DirectX 9.0, you may be prompted to restart your machine for the new drivers to take effect.
You won't be allowed to install the game if you choose not to install DirectX 9.0 and you do not already have DirectX 9.0 or better installed on your system.
For those unfamiliar with DirectX, it is an API (Application Programming Interface) set that increases the functionality and speed at which games play under the Windows operating system. These API's allow direct access to the enhanced features of hardware under Windows. With DirectX, a program has instant access to the hardware, allowing for great advances in graphics, sound, video, 3D and network capabilities of games.
If you have other Windows games on your computer, chances are you already have an earlier version of DirectX installed. In this case, the Microsoft DirectX 9.0 setup program will update your files. This should not affect any games using previous versions of DirectX.

---(b) Game Launch Problems---
Q: The game seems to stutter, and doesn't run smoothly. Is there anything I can do about this?
A: Your system may be at or below the minimum requirements for the game. Make sure that all other programs are closed before trying to
run "The Incredibles: When Danger Calls."
Q: I insert the game disk into my PC but the game menu does not appear. How can I get that menu to appear?
A: That menu is called the autorun menu. You can make it appear by making sure your CD is in the drive, then by going to My Computer and opening it. Right-click on the CD-ROM drive and choose OPEN, then double-click on autorun.exe.
---(c) Known Problems with Certain Sound and Video Cards---
The following sound cards have shown major audio difficulties on some systems:
- The sound will have a raspy quality when the game is played on a system with a Diamond Monster Sound MX 400. The latest Win9x drivers for this card were used.Drivers used:Monster Sound (es197x.vxd 4.12.0000.2008) Sound (particularly background music and dialogue during movie clips) may be lost. Sometimes these problems can be alleviated by updating the drivers to the latest version.
The following video cards have shown some minor graphical difficulties on some systems:
Windows:
- All the videos drop a lot of frames when run on an 8 MB ATi 3D Charger AGP video card (Rage IIC chipset). Audio and video playback get a little out of synch as well. Observed on last released ATi driver.
- The game does not perform at adequate frame rates on certain activities using an ATi 3D Charger video card. Activities that require better keyboard/mouse responsiveness include the Frozone's Firefighter, Kitchen Chaos, and to a lesser extent Violet Surrounded!
- All tranistion video clips become choppy and/or have slow playback. Frame rates will drop as the movies play. Drivers Used:ATI Rage 128 Xpert 128, ATI2DRAA.DRV 4.11.0001.6216 All-In-Wonder 128 AGP, ATI2DRAA.DRV 4.13.0001.7192 (latest drivers from ATI website)
- All the videos drop a lot of frames when run on an 8 MB Matrox Millennium G200 AGP video card. Audio and video playback get a little out of synch as well.Tested video drivers:MGA64D.DLL 5.00.2180.3711, G200DISP.DLL 6.12.0001.1920
- If the CD-ROM drive letter is changed after installation, please uninstall the game and re-install with the current CD-ROM drive letter.
Macintosh:
- A Macintosh running the Nvidia GeForce2 TwinView may also play movies at a resolution different from what is expected.
- The Installer stretches behind the "Dock" on a Mac G3 266 Mhz with a screen setting of 832 X 624. This bug will occur on any Mac that has the 832 X 624 display option.
- The graphics throughout the entire game are displaced to the right if the monitor is set to 832X624 on the Mac G3 266 Mhz PowerMac version 2.2. Although several Macs have the 832 X 624 display setting, this bug will only occur on the Mac known as the "All In One" A.K.A. "Molar."
- The arrow keys overlap each other when the user plays the OmniDroid activity on any of the following computers: G3 "All in One" 266 Mhz, G3 "Desktop" 300 Mhz, G3 "Tower" 333 Mhz, G3 "Blue and White" 300 Mhz, G3 "Blue and White" 400 Mhz, iMac G3 233 Mhz, iMac G3 350 Mhz, and iMac "DV Special Edition" G3 400 Mhz.
Notes: Exact Specifcations for all of the computers are as follows:
PowerMac G3 "All in One:" 266 Mhz/160 MB RAM/2 GB HD/ATI Mach 64 3DU Pro/CD-ROM.
PowerMac G3 "Desktop:" 300 Mhz/256 MB RAM/6 GB HD/ATI Mach 64 3DU Pro/CD-ROM.
PowerMac G3 "Tower:" 333 Mhz/320 MB RAM/9 GB HD/ATI Mach 64 3DU Pro/CD-ROM.
PowerMac G3 "Blue & White:" 300 Mhz/192 MB RAM/6 GB HD/ATI Rage 128/CD-ROM.
PowerMac G3 "Blue & White:" 400 Mhz/128 MB RAM/9GB HD/ATI Rage 128/CD-ROM.
iMac G3: 266 Mhz/160 MB/6 GB/ATI Rage Pro/CD-ROM.
iMac G3 "DV Special Edition:" 400 Mhz/128MB RAM/13 GB HD/ATI Rage 128/DVD-ROM.
- The FMV's appear choppy and slowly accumulate a slight sound delay on the G3 266 Mhz, G3 300 Mhz, G3 333 Mhz, and G3 iMac 266 Mhz.
Notes: This bug will only occur on the three "Beige" models, and the iMac 266 Mhz . The Particular names of the "Beige" models are the G3 "All In One" (266 Mhz), the G3 Desktop (300 Mhz) and the G3 Tower (333 Mhz). The G3 300 Mhz "Blue & White" runs the FMV's fine.

THQ Inc. Software License Agreement
1. READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE INSTALLING THE PROGRAM. THIS SOFTWARE LICENSE AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU (AN INDIVIDUAL OR A SINGLE ENTITY "YOU") ON ONE HAND, AND THQ INC. AND ITS SUBSIDIARIES AND AFFILIATES (COLLECTIVELY REFERRED TO AS "COMPANY") ON THE OTHER HAND, FOR THE SOFTWARE PRODUCT ENTITLED "THE INCREDIBLES: WHEN DANGER CALLS," WHICH INCLUDES COMPUTER SOFTWARE AND ANY ASSOCIATED MEDIA, PRINTED MATERIALS, AND/OR "ONLINE" OR ELECTRONIC DOCUMENTATION (TOGETHER CALLED THE "PROGRAM"). BY INSTALLING, COPYING, OR OTHERWISE USING THE PROGRAM (OR, IN THE EVENT YOU HAVE PURCHASED THE PROGRAM AS CONTAINED ON A CD-ROM, BY OPENING THE PACKAGING MATERIALS THEREOF), YOU ACKNOWLEDGE THAT YOU HAVE READ THIS SOFTWARE LICENSE AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THE TERMS OF THIS SOFTWARE LICENSE AGREEMENT, DO NOT INSTALL OR USE THE PROGRAM AND DELETE ALL COPIES IN YOUR POSSESSION.
2. Company grants you a non-exclusive, non-transferable license to use the Program, but retains all property rights in the Program and all copies thereof. You may: (i) use the Program on any supported computer configuration, provided the Program is used on only one (1) such computer; and (ii) permanently transfer the Program and its documentation to another user provided you retain no copies and the recipient agrees to the terms of this Agreement. You may not transfer, distribute, rent, sub-license, or lease the Program or documentation, except as provided herein; or alter, modify, or adapt the Product or documentation, or portions thereof.
3. You acknowledge that the Program in source code form remains a confidential trade secret of Company. You agree not to modify or attempt to reverse engineer, decompile, or disassemble the Program, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
4. OWNERSHIP: All right, title and interest and intellectual property rights in and to the Program (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, images, photographs, animations, video, sounds, audio-visual effects, music, musical compositions, text and "applets," incorporated into the Program), the accompanying printed materials, and any copies of the Program, are owned by Company or its licensors. This Agreement grants you no rights to use such content other than as part of the Program. All rights not expressly granted under this Agreement are reserved by Company.
5. This Agreement is effective upon your installation of the Program and shall continue until revoked by Company or until you breach any term hereof; upon termination you agree to destroy or delete all copies of the Program in your possession.
6. You shall not modify the Program or merge the Program into another computer program (except to the extent the Program is made to operate within a computer operating system and in connection with other computer programs) or create derivative works based upon the Program.
7. The Program may not be downloaded or otherwise exported or re-exported into (or to a national or resident of) any country to which the U.S. has embargoed goods or to anyone on the U.S. Treasury Department list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. If you do not meet these criteria or are not sure, do not install the software and destroy any copies in your possession. If you live in such a country, no license is granted hereunder.
8. You are responsible for assessing your own computer and the results to be obtained therefrom. YOU EXPRESSLY AGREE THAT USE OF THE PROGRAM IS AT YOUR SOLE RISK. THE PROGRAM IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS, UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION. EXCEPT WITH RESPECT TO THE LIMITED CD-ROM WARRANTY AS SET FORTH IN SECTION 9 BELOW, COMPANY AND ITS LICENSORS DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, AND THOSE ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, REGARDING THE PROGRAM. COMPANY AND ITS LICENSORS ASSUME NO RESPONSIBILITY FOR ANY DAMAGES SUFFERED BY YOU, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, ITEMS OR OTHER MATERIALS FROM ERRORS OR OTHER MALFUNCTIONS CAUSED BY COMPANY, ITS LICENSORS, LICENSEE AND/OR SUBCONTRACTORS, OR BY YOUR OR ANY OTHER PARTICIPANT'S OWN ERRORS AND/OR OMISSIONS. Company and its licensors make no warranty with respect to any related software or hardware used or provided by Company in connection with the Program except as expressly set forth above.
9. LIMITED CD-ROM WARRANTY: Notwithstanding anything to the contrary contained herein, and solely with respect to Programs distributed on CD-ROM, Company warrants to the original consumer purchaser of this Program on CD-ROM that the recording medium on which the Program is recorded will be free from defects in material and workmanship for 90 days from the date of purchase. If the recording medium is found defective within 90 days of original purchase, Company agrees to replace, free of charge, any product discovered to be defective within such period upon its receipt of the product, postage paid, with proof of the date of purchase, as long as the Program is still being manufactured by Company. In the event that the Program is no longer available, Company retains the right to substitute a similar program of equal or greater value. This warranty is limited to the recording medium containing the Program as originally provided by Company and is not applicable to normal wear and tear. This warranty shall not be applicable and shall be void if the defect has arisen through abuse, mistreatment, or neglect. Any implied warranties prescribed by statute are expressly limited to the 90-day period described above. To receive warranty service in the United States: Notify the THQ Customer Service Department of the problem requiring warranty service by calling (818) 880-0456 or on the web at http://www.thq.com. If the THQ service technician is unable to solve the problem by phone or on the web via e-mail, he will authorize you to return the Product, at your risk of damage, freight and insurance prepaid by you, together with your dated sales slip or similar proof-of-purchase within the ninety (90) day warranty period to: THQ Inc., Customer Service Department, 27001 Agoura Road, Suite 325, Calabasas Hills, CA 91301. To receive warranty service in the United Kingdom: Notify the THQ (UK) Limited. Customer Service Department of the problem requiring warranty service by calling +44 (0) 870 608 0047 (national/international call rates apply) or on the web at http://www.thq.co.ukand click on Help. If the THQ (UK) Limited. service technician is unable to solve the problem by phone or on the web via e-mail, the technician will authorize you to return the Product, at your risk of damage, freight and insurance prepaid by you, together with your dated sales slip or similar proof-of-purchase within the ninety (90) day warranty period to: THQ (UK) Limited., Customer Service Department, Duke's Court, Duke Street, Woking, Surrey GU21 5BH UK. To receive warranty service in Australia: Notify the THQ Technical support and Games Hotline of the problem requiring warranty service by calling 1902 222 448 (call cost $2.48 (incl GST) per minute - higher from mobile/public phones) or via e-mail at [email protected]. Company is not responsible for unauthorized returns of the Program and reserves the right to send such unauthorized returns back to customers. This warranty shall not be applicable and shall be void if: (a) the defect in the Program has arisen through abuse, unreasonable use, mistreatment or neglect; (b) the Program is used with computer software and hardware not meeting the minimum systems requirements for the Program; (c) the Program is used for commercial purposes (including rental); (d) the Program is modified or tampered with; or (e) the Program's serial number has been altered, defaced or removed. Licensor will replace defective media at no charge as set forth above. This is your sole and exclusive remedy for any breach of warranty.
10. LIMITATION OF LIABILITY. YOU ACKNOWLEDGE AND AGREE THAT COMPANY AND ITS LICENSORS SHALL NOT ASSUME OR HAVE ANY LIABILITY FOR ANY ACTION BY COMPANY OR ITS CONTENT PROVIDERS, OTHER PARTICIPANTS OR OTHER LICENSORS WITH RESPECT TO CONDUCT, COMMUNICATION OR CONTENT OF THE PROGRAM. COMPANY AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, USE, OR MALFUNCTION OF THE PROGRAM, INCLUDING DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT AS EXPRESSLY PROVIDED HEREIN, COMPANY'S AND ITS LICENSORS' ENTIRE LIABILITY TO YOU AND YOUR EXCLUSIVE REMEDY FOR ANY BREACH OF THIS AGREEMENT IS LIMITED SOLELY TO THE TOTAL AMOUNT PAID BY YOU FOR THE PROGRAM, IF ANY. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, IN SUCH STATES COMPANY'S AND ITS LICENSORS' LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.
11. INJUNCTION. Because Company would be irreparably damaged if the terms of this License Agreement were not specifically enforced, you agree that Company shall be entitled, without bond, other security or proof of damages, to appropriate equitable remedies with respect to breaches of this Agreement, in addition to such other remedies as Company may otherwise have under applicable laws.
12. INDEMNITY. At Company's request, you agree to defend, indemnify and hold harmless Company, its affiliates, contractors, officers, directors, employees, agents, licensors, licensees, distributors, content providers, and other users of the Program, from all damages, losses, liabilities, claims and expenses, including attorneys' fees, arising directly or indirectly from your acts and omissions to act in using the Program pursuant to the terms of this License Agreement or any breach of this License Agreement by you. Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you hereunder, and in such event, you shall have no further obligation to provide indemnification for such matter.
13. U.S. GOVERNMENT RESTRICTED RIGHTS. The Program and documentation have been developed entirely at private expense and are provided as "Commercial Computer Software" or "restricted computer software." Use, duplication or disclosure by the U.S. Government or a U.S. Government subcontractor is subject to the restrictions set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clauses in DFARS 252.227-7013 or as set forth in subparagraph (c)(1) and (2) of the Commercial Computer Software Restricted Rights clauses at FAR 52.227-19, as applicable. The Contractor / Manufacturer is THQ Inc., 27001 Agoura Road, Suite 325, Calabasas Hills, CA 91301.
14. TERMINATION. Without prejudice to any other rights of Company, this License Agreement and your right to use the Program may automatically terminate without notice from Company if you fail to comply with any provision of this Agreement or any terms and conditions associated with the Program. In such event, you must destroy all copies of this Program and all of its component parts.
15. GENERAL PROVISIONS. You may not use, copy, modify, sublicense, rent, sell, assign or transfer the rights or obligations granted to you in this Agreement, except as expressly provided in this Agreement. Any assignment in violation of this Agreement is void, except that you may transfer your Program to another person provided that person accepts the terms of this License Agreement. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and such decision shall not affect the enforceability of: (i) such provision under other circumstances, or (ii) the remaining provisions hereof under all circumstances. Company's failure to enforce at any time any of the provisions of this Agreement shall in no way be construed to be a present or future waiver of such provisions, nor in any way affect the right of any party to enforce each and every such provision thereafter. The express waiver by Company of any provision, condition or requirement of this Agreement shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement. Notwithstanding anything else in this Agreement, no default, delay or failure to perform on the part of Company shall be considered a breach of this Agreement if such default, delay or failure to perform is shown to be due to causes beyond the reasonable control of Company. This Agreement shall be governed by the laws of the State of California and the United States without regard to its conflicts of laws rules and you consent to the exclusive jurisdiction of the state and federal courts in Los Angeles County, California. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement. This Agreement represents the complete agreement concerning this License Agreement between you and Company.
